TERMS AND CONDITIONS
AVOKADO Service Terms and Conditions and Privacy Policy are made to determine the terms, conditions and legal engagements that bind the User (Merchant/ merchant owner/ authorized party to represent the merchant owner), by using Avokado’s services, the User legally :
1. Acknowledging that the User has read and understood the entire contents of the Terms and Conditions and the Privacy Policy which is an integral part of these Terms and Conditions;
2. Agree to be bound by and be subject to the Terms and Conditions, and;
3. Knowing every legal consequence and enforcement of the Terms and Conditions as well as the legal consequences in the form of violation of the Terms and Conditions as described in these Terms and Conditions.
CONDITIONS FOR IMPLEMENTATION TRANSACTION
MERCHANT must accept Transactions made by Customers without minimum payment restrictions and provide the best service to Customers.
RIGHTS AND OBLIGATIONS OF AVOKADO
Avokado’s Obligation
1. Perform the Settlement process as agreed.
2. Provide education and socialization regarding the transaction mechanism using the facilities provided by Avokado.
Avokado’s Rights
1. Imposing fees to the Merchant as stated in the Merchant Form.
2. Collecting chargebacks (in the event of conditions that cause chargeback);
3. Conduct investigations, provide terminations and unilaterally terminate Cooperation in the event of indications / proven violations of prohibitions and / fraud.
RIGHTS AND OBLIGATIONS OF MERCHANTS
Merchant’s Rights
1. Receive Settlement funds.
2. Receive education and socialization regarding the transaction mechanism by using the facilities provided by Avokado.
Merchant’s Obligation
1. Fill out and complete the Merchant Form or through media or other facilities provided by Avokado and submit the supporting documents required by AVOKADO, in accordance with the procedures applicable at AVOKADO.
2. Pay MDR and other fees (if any) to AVOKADO in the amount as stated in the Merchant Form.
3. Complete all MERCHANT’s obligations to the Customer for each Transaction in accordance with the MERCHANT’s agreement with the Customer.
4. Provide correct information on its activities either orally or in writing and give approval to AVOKADO in order to obtain information required by AVOKADO.
5. MERCHANT must receive and handle all complaints from Customers in real time.
PROHIBITIONS AND SANCTIONS
1. In terms of MERCHANT, among others:
a. Accepting transactions that are not in accordance with regulated procedures and applicable regulatory provisions.
b. Imposing additional fees in any form to the Customer (surcharge fee).
c. Documenting and/or storing and/or providing electronic money data with tools other than the AVOKADO application.
d. Blacklisted by the Indonesian Credit Card Association (AKKI)
e. Doing business that is contrary to the applicable laws and regulations or not in accordance with the business field known to AVOKADO.
f. Forge/modify transaction proof documents.
g. Use the name, logo, brand or any other kind of intellectual property rights owned by AVOKADO without AVOKADO’s prior written consent.
h. Proven/indicated of committing fraud.
2. Violating part or all of the provisions in the Terms and Conditions and the Agreement and its attachments, then all losses that arise as a result of violating the prohibition by the MERCHANT, are the full responsibility of the MERCHANT
3. Proven to be involved/committed Fraud, the MERCHANT will be subject to sanctions in accordance with the applicable law at AVOKADO, including processing the applicable law
REFUND
In the case of Chargeback and/or Refund caused by:
1. Goods are returned, services are not provided and/or the transaction is canceled by the Customer with the approval of the FIRST PARTY (Void)
2. The customer denies having made a Transaction.
3. The sale of goods and/or services violates applicable laws or regulations;
4. There has been an error or error in Settlement by the MERCHANT or a payment error by the Customer;
5. In the event that the Transaction contains an element of fraud or is carried out not by a valid Cardholder / Customer after the Issuer / Issuer has verified and reported it to AVOKADO
AVOKADO will convey to the Acquirer to process the Refund and return the funds to the Credit Card limit / Customer balance.
• Funds will be returned to the customer on 7 (seven) until 15 (fifteen) business days after the refund process has been carried out.
• For cross-border transactions, the refund process to customers takes a maximum 50 (fifty) days.
Cancellation
Cancellation is canceled unilaterally if:
1. You haven’t made a payment within 3 x 24 hours.
2. We have not received your payment.
3. The valid date on the invoice for the order has expired.
FORCE MAJEURE
1. Matters that can be considered Force Majeure include natural disasters, wars, riots, strikes, disease outbreaks, fires, and Government policies that are officially directly related to the implementation of this cooperation, as well as other things that cannot be avoided. because it is beyond the capabilities of the PARTY, so that one of the PARTY or the PARTY cannot carry out its rights and obligations.
2. PARTIES experiencing Force Majeure cannot be held responsible for all consequences arising from conditions that are considered Force Majeure.
3. In the event of a Force Majeure, the PARTY affected by the Force Majeure must notify the other PARTY in writing no later than 7 working days after the occurrence of the Force Majeure, to be resolved by deliberation and consensus.
TERMINATION OF RELATIONSHIP
1. In the event that MERCHANT decides to terminate the Service, MERCHANT may contact the Call Center no later than 30 (thirty) days prior to the desired termination date.
2. The effective date of termination recognized by AVOKADO is when all obligations of the MERCHANT have been completed including but not limited to the return of all facilities/facilities/terminals that have been returned by MERCHANT to AVOKADO.
3. For Merchants who use Electronic Money, termination of the relationship between Merchant and AVOKADO does not simultaneously terminate Electronic Money services, Users are required to read the Terms and Conditions for Termination of Electronic Money on the relevant page.
4. AVOKADO with certain considerations has the right to refuse or terminate cooperation with MERCHANT without the need to explain the reason.
